Terms of use

These terms govern the use of the Plan, Train & Progress app for iPhone, Android and Apple Watch. By downloading and using it you accept them. On iPhone and Apple Watch, Apple’s standard licensed application end user licence agreement (EULA) also applies, and on Android the Google Play Terms of Service; they prevail on the matters they cover.

Licence

We grant you a personal, non-exclusive and non-transferable licence to use the app on devices that you own or control, in accordance with the App Store or Google Play rules.

Free launch and free trial

Until we open the subscription, the app is free and has every feature. When we open it, we will say so in the app and on this website.

From that day you get a 30-day free trial with every feature, without entering any payment method. If you download the app after the subscription opens, the trial counts from your first download with your store account.

Subscription

• When the trial ends, starting new sessions and creating or editing routines need a monthly or yearly subscription. Your history, records, charts and the exercise library remain available without a subscription, and a session that was already running can be finished.
• The subscription is paid in the App Store or Google Play and charged to your store account when you confirm the purchase.
• It renews automatically for the same period unless you cancel it at least 24 hours before the end of the current period. You can manage and cancel it in your App Store or Google Play subscriptions.
• The price, taxes included, is shown in the store before you buy. If it changes, the store will let you know under its own rules.
• Refunds and the right of withdrawal are handled by the store you bought from (Apple: reportaproblem.apple.com; Google Play: your account’s order history) under its terms.

Health and responsible use

The app is a tool for planning and logging workouts. It is not a medical device and gives no medical advice, and the heart rate and calories it shows are estimates. Talk to a health professional before starting a training programme, especially if you have an injury or a medical condition, and train within your limits. Exercise instructions and illustrations are for guidance only.

Your data

Your data is stored on your devices, as the Privacy policy explains. App updates always keep your data; even so, we recommend keeping your phone’s backups turned on.

Intellectual property

The app, its design, texts, illustrations and code belong to the owner or are used under licence. You may not copy, modify, decompile or distribute them except as the law allows.

Changes to the app

We may update the app and add, change or remove features. If a change significantly reduces what the subscription includes, we will give reasonable notice.

Liability

To the extent permitted by law, the owner is not liable for damage arising from misuse of the app or for injuries that may occur while training. Nothing in these terms limits the rights consumer protection law gives you.

Governing law

These terms are governed by Spanish law. If you act as a consumer, the courts of your place of residence have jurisdiction over any dispute.
